Trove Terms of Service

These Terms of Service ("Terms") govern your use of the Trove mobile application ("App") provided by Alt Terra LLC ("Alt Terra," "we," "us," or "our"), an Oregon limited liability company. You accept these Terms when you agree to them in the App, and we may keep a record of that acceptance as described in our Privacy Policy. If you do not agree, do not use the App.

These Terms include a binding arbitration agreement and a class action waiver (Section 14). You can opt out of arbitration within 30 days, as described there.

1. Availability and Eligibility

Trove is offered in the United States through the U.S. App Store. If you use the App from elsewhere, you do so at your own risk and are responsible for compliance with local law.

You must be at least 18 years old and a resident of the United States to use Trove.

2. The Service

Trove is a personal inventory app for iOS. Some of its features use artificial intelligence, including processing by third-party AI providers. How your information is handled is described in our Privacy Policy.

3. Your Content

You own the content you add to, store in, or submit through Trove, such as photos, receipts, documents, notes, and inventory details. So that the App can work, you grant Alt Terra a worldwide, non-exclusive, royalty-free license to store, process, transmit, and modify your content, including creating new images or text from it at your request, and to share it with our service providers, as needed to provide the App's features to you. This license ends when you permanently delete your content from Trove, except for processing already underway and copies our service providers keep for a limited time under their own terms. You are responsible for the content you add to Trove or submit through it.

4. Subscriptions and Payments

Trove offers a free plan and paid subscriptions that unlock additional features and AI usage.

1. a) Paid plans are auto-renewing subscriptions, billed at the interval shown when you subscribe, such as weekly or monthly. Payment is charged to your Apple Account at confirmation of purchase.
2. b) Subscriptions renew automatically unless canceled at least 24 hours before the current period ends. Your Apple Account is charged for the renewal within the 24 hours before the period ends. You can manage or cancel them in your App Store account settings.
3. c) Payments are processed by Apple.
4. d) Some plans may include a free trial or other introductory offer, described at the point of purchase. Eligibility is determined by Apple. Unless you cancel at least 24 hours before a free trial ends, it converts to a paid subscription and your Apple Account is charged. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
5. e) AI usage included with a plan is subject to limits that reset each billing period. Usage may be counted when a request is made, including requests the AI provider declines, requests that fail, and requests that return no result. Some plans may include a one-time AI allowance that does not reset. We may change features, usage limits, and pricing over time; price changes are handled through the App Store and take effect at a later renewal.
6. f) Payments and refunds are handled by Apple under its policies, so refund requests go to Apple. A subscription stays with the Apple Account that bought it, except as Apple allows.

5. AI Features and AI-Generated Content

1. a) Some features generate images or text, or analyze your photos and text, using AI. Depending on the feature, this processing happens on your device or through a third-party AI provider, currently Google's Gemini. How your information is handled, including the consent we ask for before sending it to an AI provider, is described in our Privacy Policy.
2. b) AI output may be inaccurate, incomplete, or inappropriate. It is provided for convenience only; you are responsible for verifying it before relying on it, and we make no guarantee of its accuracy or quality.
3. c) Alt Terra does not claim ownership of AI-generated content. Your rights to use AI outputs are subject to Apple's terms and Google's Gemini API Terms of Service (https://ai.google.dev/gemini-api/terms).
4. d) You are responsible for the content you submit to AI features, including anything visible in the photos you send. You may not use AI features to create content that is harmful, illegal, abusive, deceptive, or infringing.
5. e) Requests may be analyzed by Google's automated safety systems under the Gemini API Terms of Service. Responses (both text and image generated outputs) may be filtered or blocked based on these filters. If many of your requests are blocked, your access to AI features may be suspended automatically for a period (see Section 7).

6. Affiliate Links

When you open Amazon links saved in Trove, the App may add Alt Terra's affiliate code, a code that lets us earn a commission on qualifying purchases, replacing any affiliate code already in the link. As an Amazon Associate, we earn from qualifying purchases.

7. Acceptable Use

You agree not to use Trove for any illegal purpose; circumvent subscription restrictions or usage limits; reverse engineer, decompile, or extract proprietary information from the App; interfere with or disrupt the App or its services; or share your subscription with others, except as Apple allows.

If we detect misuse of the App or its services, including through the automatic suspension described in Section 5, or otherwise have reason to believe the App is being used in bad faith, we may limit or end your access to our online services, including AI features, with or without notice. Refunds, if any, are handled by Apple under its policies.

8. Feedback and Support

You can send feedback or report content by email to feedback@altterra.app, or with the report option shown on some AI results in the App. For help, contact support@altterra.app. By submitting feedback, ideas, or suggestions, you grant Alt Terra a perpetual, irrevocable, royalty-free license to use them for any purpose without compensation or obligation to you, and you agree that they are not confidential. Content attached to a report, such as an image or an AI result, is not treated as feedback under this section; we may keep and use it for as long as we need to look into the report.

9. Intellectual Property

Trove, including its name, logos, design, and software, belongs to Alt Terra LLC. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes under these Terms.

10. App Store Terms

Trove is distributed through the Apple App Store, and the following terms apply in addition to the rest of this agreement:

1. a) Acknowledgement: These Terms are between you and Alt Terra LLC only, not Apple. Alt Terra, not Apple, is solely responsible for Trove and its content. Your use of the App Store is also governed by Apple's Media Services Terms and Conditions.
2. b) Scope of license: Your license to Trove is a non-transferable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the App may be accessed, acquired, and used by other accounts associated with you through Family Sharing, volume purchasing, or Legacy Contacts.
3. c) Maintenance and support: Alt Terra is solely responsible for providing any maintenance and support for Trove. Apple has no obligation to provide maintenance or support for the App.
4. d) Warranty: Alt Terra is solely responsible for any product warranties, express or implied by law, to the extent not disclaimed in these Terms. If Trove fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App, if any, to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Trove; any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Alt Terra's responsibility.
5. e) Product claims: Alt Terra, not Apple, is responsible for addressing any claims by you or a third party relating to Trove or your possession or use of it, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims under consumer protection, privacy, or similar law.
6. f) Intellectual property: If a third party claims that Trove, or your possession or use of it, infringes that third party's intellectual property rights, Alt Terra, not Apple, is solely responsible for investigating, defending, settling, and discharging the claim.
7. g) Legal compliance: You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
8. h) Third-party terms: You must comply with any applicable third-party terms of agreement when using Trove, such as your wireless data service agreement and the terms of the third-party services described in our Privacy Policy.
9. i) Third-party beneficiary: Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right, and is deemed to have accepted the right, to enforce them against you as a third-party beneficiary.
10. j) External services: Trove may give access to third-party websites and services, such as product pages you link and the AI provider described in our Privacy Policy. You use them at your own risk; we are not responsible for their content or accuracy, and we may change, suspend, or remove access to them, with or without notice.
11. k) Questions, complaints, or claims about Trove should be directed to the contacts in Section 18.

11. Disclaimer of Warranties

TROVE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ALT TERRA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OF AI-GENERATED CONTENT OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ALT TERRA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF OR INABILITY TO USE TROVE. OUR TOTAL LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE SUBSCRIPTION FEES YOU PAID FOR TROVE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50), REGARDLESS OF THE THEORY OF LIABILITY.

13. Indemnification

You agree to indemnify and hold harmless Alt Terra LLC from claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution and Arbitration

1. a) Any dispute arising from these Terms or your use of Trove will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in the State of Oregon, rather than in court.
2. b) CLASS ACTION WAIVER: Disputes will be resolved only on an individual basis, not as a class, consolidated, or representative action. If a court decides that this class action waiver cannot be enforced for a particular claim or remedy, then that claim or remedy (and only that one) will be decided in court, and the rest of this Section still applies.
3. c) This provision does not apply to claims that may be brought in small claims court.
4. d) Opting out: You may opt out of this arbitration agreement by mailing a written notice to Alt Terra LLC, 5441 S Macadam Ave, Ste N, Portland, OR 97239, postmarked within 30 days after you first accept a version of these Terms that includes this section. Your notice must include your name, the Trove ID shown in the App's settings (if one is shown), the email address or Apple Account you use with the App, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.

15. General

1. a) Governing law: These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules.
2. b) Severability: If any provision is held unenforceable, it will be modified to the minimum extent necessary or severed, and the rest of these Terms remain in effect.
3. c) Force majeure: We are not liable for failures or delays caused by circumstances beyond our reasonable control, including third-party service outages, internet disruptions, natural disasters, or acts of government.

16. Termination

You can stop using Trove by deleting the App. Deleting the App removes your Trove library from your device, although a small amount of information iOS keeps for the App, such as information about your plan, may remain. Whether your data is also saved in your iCloud account, and whether you can make a backup, depends on your plan and settings; data kept only on your device cannot be recovered after you delete the App. Data in your iCloud account and the information our servers keep are handled as described in our Privacy Policy. We may restrict, suspend, or terminate your access as described in Section 7. You are responsible for canceling an active subscription through the App Store.

17. Changes to These Terms

We may update these Terms from time to time. When we make important changes, we will ask you to review and accept the updated Terms in the App.
